The Administrative Appeals Tribunal (AAT) is the review body for most administrative decisions by the Federal Government. In 2015, the operations of the Migration Review Tribunal (MRT) and Refugee Review Tribunal (RRT) were absorbed into the Migration Division of the AAT.

FEDERAL COURT APPEAL

In Australia, there are three courts that hear visa appeals; the Federal Circuit Court of Australia (FCC), Federal Court and High Council. Most cases first go to the Administrative Appeals Tribunal or Immigration Assessment Authority before they get appealed to a court.

If you’re denied at these levels, your case may be heard by either the FCC or Council depending on circumstances-although it’s best not to try this without legal advice as the process can be challenging. MINISTERIAL INTERVENTION

If your visa has been refused and you have exhausted the appeals processes, ministerial intervention is a possibility to override the decision.
